RECYCLING CHANGES COMING SOON
City of Glenview Hills

Rumpke is to change recycling this coming April. Please read attached flyers provided by Rumpke for clarification.
In the last week of March, new recycling carts will be delivered to each household;
April 5th will be the last time for the old bins, which will also be taken away with the recycled materials.
April 12th will be the first time for the new carts and then every other Thursday thereafter.
Please, let me know if you have any concerns or questions.

Reminder from City of Glenview Hills
The Glenview Hills City Council would like to remind its residents that we are governed by the ordinances set forth by the Metro Department of Animal Services. If you need to register a complaint or have any questions, please contact Animal Services directly at 502-363-6609.
The following section of Ordinance No. 290, Series 2007, is specific to animal restraint. To view Ordinance No. 290, Series 2007 in its entirety please visit the website listed at the end of this Reminder message.
SECTION I. Chapter 91
§ 91.002 RESTRAINT REQUIRED.
All animals shall be kept under restraint at all times, as defined in this chapter, except as otherwise provided herein, and any deviation or violation thereof is strictly prohibited.
RESTRAINT.
1) For all animals except puppies and dogs, RESTRAINT shall mean on the premises of the owner or on premises which the animals presence has been explicitly allowed, or, if off the premises of the owner where permission has not been granted, under restraint by means of a lead or leash or in a cage or carrier and under the control of a responsible person.
(2) For puppies and dogs, RESTRAINT shall mean on the premises of the owner or on premises which the animals' presence has been explicitly allowed, and confined in a secure enclosure, or accompanied by the owner and under his/her direct control. If off the premises of the owner where permission has not been granted, the animal must be restrained by a lead or leash and under the control of a responsible person physically able to control the dog, or except for dangerous dogs, and potentially dangerous dogs, accompanied by a responsible person into an enclosed "off-leash" area designated by the Kentucky Department of Parks or the Metro Department of Parks and in conformance with all regulations and/or requirements imposed as a condition of utilizing such "off-leash" area by such Departments of Parks, or their designees.
(3) In addition to the requirements of subsection (2), above, under this definition, RESTRAINT for dangerous dogs, and potentially dangerous dogs shall mean as follows:

- (b) That owners of dangerous dogs, and potentially dangerous dogs shall not allow the dog to be outside an enclosure as defined in this chapter unless the dog is confined to a secure cage, or is chained, leashed, and is under the control of a person physically able to restrain the dog.
- (c) That a lead or leash for a potentially dangerous or dangerous dog shall not exceed four feet in length.
(4) Other standards and requirements for restraining dogs shall be as set forth in § 91.091.

Upon official certification by the Board of Elections, the following residents were sworn in by Mayor Fred Simon on December 20, 2008, to serve as Commissioners for Glenview Hills for the next four years:

Jason Dusch – Streets, Utilities (lights) and Signs
Robert McGonnell – Security and Community Relations
Deborah Bates-Fulks – City Contracts (Insurance and Sanitation)
City Treasurer Bill Galloway reports that all taxes assessed upon real estate for the current year have been paid by residents. Property owners are reminded that Glenview Hills receives a portion of its annual revenues from taxes assessed on premiums paid for title insurance, life insurance, casualty and liability insurance on home, car, marine and other risks and perils. The tax is five percent (5%) and amounts to approximately $16,000.00 per year. Please check your vehicle license renewal form and your insurance premium invoices to make sure that the taxing authority is correctly identified as Glenview Hills (rather than Glenview or the City of Louisville) and insure that the City will receive these revenues.

City News
At the regular monthly meeting of the City Commissioners held in October, 2008, Treasurer Bill Galloway reported that all City real estate property taxes for this fiscal year have been collected. Fortunately, the recent wind storm did minor damage to common areas and did not require significant expenditures.
A new streetlight was approved for installation on Carlingford Drive between Wagram Way and Burlington Avenue.
City Attorney Doug Farnsley is continuing his work with (Metro Police Sgt.) Jamey Schwab who provides security services for Glenview Hills to obtain cost effective professional liability coverage while performing his duties for the City.
One additional “junk day” will be scheduled with Rumpke before the end of the year. Advance notice will be provided to the residents.
Katie Carnazzo has graciously agreed to update the Glenview Hills resident directory. However, there remains a vacancy in the appointed position of City Clerk. Anyone interested in assisting the City by assuming these duties should contact any Commissioner or Mayor Fred Simon.
Candidates for election of Glenview Hill’s four Commissioners for the next term will appear on the ballot on November 4, 2008. Those residents who have registered are (in alphabetical order) Jason Dusch, Deborah Fulks, Al Gustafson, Robert McGonnell, and Virginia Schulte.
Glenview Park Update
After the Planning Commission approved the Glenview Park Subdivision plan on May 29, 2008, a decision was made by a group of neighbors, with the support of the City of Glenview Hills, at about 4:00 PM on Saturday, June 28, 2008, to file an appeal of that decision. The deadline for filing was Monday, June 30, 2008, and the appeal was filed that day. Named as Defendants were the Planning Commission, Fincastle Group, LLC (the owner and developer), and Eugenia Falls (owner). A motion was made by the Defendants to dismiss the case because the Appeal did not include as a Defendant the Canfield Development Corporation, the initial “applicant”. On September 30, 2008, after memorandums were filed by both sides and a hearing was held, Circuit Judge James Shake dismissed the appeal for not listing Canfield as a Defendant. A Notice of Appeal of Judge’s ruling will be filed in the Kentucky Court of Appeals by October 30, 2008. Attorney Steve Porter believes that he has good grounds for a successful appeal, but appeals are always difficult.
At the same time, negotiations are continuing to try to reach a compromise with the developer/owners of the property.

Special Meeting and Subsequent Action

On Saturday, June 28, the Commissioners of Glenview Hills held a special meeting to consider issues involving the proposed Glenview Park subdivision. Commissioners Lampe, Schulte, Gustafson, and LaMay were in attendance. Also in attendance were City Treasure Galloway, City Attorney Farnsley, attorney Steve Porter, and numerous citizens of Glenview Hills. May Simon was out of state and not able to participate. In the Mayor’s absence, Commissioner Lampe presided. City Clerk Wobbe had provided written notice to the citizens of Glenview Hills more than 24 hours before the meeting.
In May, the Louisville Planning Commission approved the subdivision by a vote of 8-0 with on abstention. The plan for the subdivision provides for 52 lots and provides for one means of access, via Lime Road, Glenview Road, and Cabin Way. Opponents to the subdivision have argued that Glenview Road is a private road and, therefore may not be used for access.
The remedy for those who disagree with the approval is to appeal to the Jefferson Circuit Court. In addition to arguing the private road issue, opponents would argue that the subdivision should have a second point of access onto Woodside Road and would make additional arguments.
Mr. Farnsley provided to those in attendance copies of two letters that set forth an offer from the developer to Glenview Hills. The offer was conditioned on no appeal being taken by the City or by anyone else. The offer included reducing the number of lots from 52 to 46, making a $20,000 contribution to the City, committing to repave Lime Road when the subdivision is substantially complete, committing 10% of the subdivision’s Homeowners Association dues to the City to help maintain Lime Road, and further inducements.
Commissioner Lampe gave all those in attendance the opportunity to express their views and to ask questions. A petition signed by representatives of more that 80 of the City’s households was presented to the Commissioners. The petition sought financial support from the City to assist with legal fees that would be incurred in pursuing an appeal.
Following the discussion, Commissioner Gustafson moved that the City expend $10,000 to be contributed to the cost of an appeal that will be taken by various citizens of Glenview Hills and by others. Mr. LaMay seconded, and the Commissioners approved the motion by a vote of 3-0.
Mr. Porter has moved forward with the appeal of the Planning Commission’s action by filing suit in Jefferson Circuit Court. The Complaint filed on Monday, June 30, by Mr. Porter seeks the setting aside of the Planning Commission’s approval of Glenview Park Subdivision, and that the Court instruct the Planning Commission to enforce its own requirements that abutting public and private streets be extended through any adjoining new subdivision. Additionally, that the Planning Commission be instructed that it has no authority to declare a private street to be public and no jurisdiction to interpret the deeds regarding the access easement questions.

Neighborhood Update
At the May regular monthly meeting, City Attorney Doug Farnsley reported that he had not been informed of any further action taken regarding the Glenview Park development. However, since that meeting Attorney Steve Porter advises that Canfield has submitted a new plan to the Planning Commission slightly increasing the number of proposed lots to 52. A modified entrance location for the subdivision from Cabin Way is included, but Lime Road continues to be the main access thoroughfare. This plan is scheduled to be presented to the May 29 hearing at the Planning Commission.
A first reading of a proposed annual budget for the fiscal year 2008-2009 for the City was presented by City Treasurer, Bill Galloway. Drafts of ordinances incorporating and maintaining the same tax rates as previous years were distributed. A discussion about enacting an increase in the tax rate to enlarge the City’s available funds for contingency expenses was had, but no action was taken. The Glenview Hills Commissioners will hold the second reading on the proposed budget at the June monthly meeting, at which time it is expected to be voted upon and approved.
Commissioners Ken Lampe and Virginia Schulte will soon be posting Rumpke's holiday schedule on the website. This schedule advises residents of the dates for waste pick up during the weeks of major holidays such as Memorial Day, July 4, and so forth.
Finally, while the Commissioners would prefer that residents not use the City stop signs or light or street signs to post notices, they do understand that circumstances sometimes compel the need to advertise for lost pets, etc. We request, however, that should you use this method, that you timely remove all papers, tape and other materials before they become unsightly.

Neighborhood Update
At the April regular monthly meeting, the Glenview Hills Commissioners recommended that our City Attorney participate in discussions with the attorney for Canfield Development. The purpose of the discussions would be to address and resolve concerns of residents of Glenview Hills with regard to the proposed development of the Glenview Park subdivision off Cabin Way. The Commissioners also authorized the expenditure of funds to contribute to future legal fees accrued by Attorney Steve Porter, who continues to represent some Glenview Hills residents and other non-residents over the proposed development.
In other matters, the landscaping at the Glen Hill Road entrance to Glenview Hills is undergoing substantial renovation work. After many months of consideration and review of several proposed plans, the efforts of Commissioner Virginia Schulte and other citizens with professionals to improve the appearance of the entrance are finally coming to fruition. However, work has been slowed by the large amount of rain we have experienced. The clean up of bamboo and a fallen tree along Lime Road has also been delayed by the heavy rains.
During the next few months, the Glenview Hills Commissioners, with the assistance of our experienced Treasurer, Bill Galloway, will consider, propose and adopt a budget for the coming fiscal year. Those residents who are interested in learning more about our budget and this process should attend our future monthly meetings.
